Utah charges Kalshi bosses, rivals pull back contracts
Polymarket & others are taking a wait-&-see approach as Utah’s cases against Kalshi move through the courts.
The hit
Fanatics Markets will cut off all Utah users from 8am local time on Wednesday 4 November 2026, according to DeFi Rate. DKeX & FanDuel Predicts have already stopped processing Utah contracts tied to culture, politics & sports, though financial-market contracts stay live on both. The moves follow Utah attorney general Derek Brown filing criminal charges against Kalshi & its co-founders.
Why it matters
DraftKings, Fanatics & FanDuel can afford to retreat because prediction contracts are a side business sitting alongside regulated online gambling revenue, according to DeFi Rate. Kalshi & Polymarket have no such cushion, so pulling back in any state costs them more. Fast-moving litigation across multiple courts is also why Polymarket & others are taking a wait-&-see approach. The Wednesday cutoff also leaves room for Fanatics to collect fees tied to the 2026 elections before switching off Utah access.
The record
| Preliminary injunction denied | US District Court for Minnesota & 10th Circuit refused Kalshi relief against Utah officials |
|---|---|
| Pending appeal | Kalshi’s civil suit against Utah Gov. Spencer Cox, at the 10th Circuit |
| Supreme Court petitions | Three petitions for review in two cases awaiting a SCOTUS decision |
What happens next
Watch the 10th Circuit’s ruling on Kalshi’s appeal & whether the Supreme Court grants any of the pending petitions.
