Trump admin sues Utah to shield Kalshi after state’s win
Utah’s attorney general says Kalshi runs an online casino disguised as a prediction market.
The hit
The US Commodity Futures Trading Commission has sued Utah to stop the state shutting down Kalshi, making Utah the 10th state sued by the regulator. The move comes after Utah beat Kalshi in a separate federal court case, & after Utah itself sued Kalshi in state court seeking to ban its sports, election & politics contracts.
Why it matters
The fight is over who gets to regulate prediction markets at all. If Utah can shut down Kalshi, that could spell trouble for Kalshi’s rival Polymarket, & for sports betting sites DraftKings & FanDuel, which also offer CFTC-registered products in states like Utah.
The record
| States sued by the CFTC | 10 |
|---|---|
| Utah’s state court lawsuit | filed last week, seeks ban on Kalshi’s sports, election & politics bets (Utah AG Derek Brown) |
| Utah’s constitutional gambling ban | one of only two such state bans in the US (Utah AG Derek Brown) |
| Kalshi’s earlier federal case | lost to Utah after Kalshi sought to pre-empt state enforcement |
What happens next
Watch how Utah answers the CFTC’s lawsuit, & whether other states follow Utah’s move against Kalshi-style prediction markets.
