Kalshi sues Missouri, calls cease-&-desist impossible to meet
Nadex, which runs Crypto.com-backed OG.com, sued Utah the same day the CFTC filed a federal complaint, citing similar jurisdiction arguments.
The hit
Kalshi has filed a federal lawsuit against Missouri, arguing the state’s cease-&-desist order against its sports-event contracts offers no realistic path to compliance, according to SBC Americas. The suit names Attorney General Catherine Hanaway & the Missouri Gaming Commission. It follows a cease-&-desist letter demanding Kalshi stop offering sports contracts or get licensed.
Why it matters
Kalshi says federal law gives the CFTC exclusive jurisdiction over event contracts, so state gambling rules can’t apply. It also argues Missouri’s licence routes are effectively closed to it, since two mobile sports betting licences already went to DraftKings & Circa Sports & others require casino or sports-team ties.
The record
| Cease-&-desist letter issued | 16 September (Missouri) |
|---|---|
| Original compliance deadline | 16 October, extended to 30 October (Missouri) |
| State refused enforcement guarantee | Tuesday, per Kalshi (Missouri solicitor general) |
| Parallel case | Nadex, which runs Crypto.com-backed OG.com, sues Utah same day as CFTC federal complaint |
| Utah’s own suit against Kalshi | Filed 20 October, seeks to block contracts & recover alleged losses |
What happens next
Kalshi intends to seek a preliminary injunction; Missouri’s extended compliance deadline falls on 30 October.
